Welcome to OahuJunkHaulers.com. These Terms of Service (“Terms”) govern your access to and use of the OahuJunkHaulers.com website, forms, directories, referral services, content, and related features collectively referred to as the “Site.”

The Site is owned and operated by Oahu Junk Haulers LLC, referred to in these Terms as “Oahu Junk Haulers,” “we,” “us,” or “our.”

By accessing the Site, submitting a service request, contacting a service provider through the Site, or otherwise using the Site, you agree to these Terms. Do not use the Site if you do not agree to them.

1. Our Role

OahuJunkHaulers.com is an online directory, advertising, marketing, and lead-generation service that helps consumers connect with independent junk-removal companies, haulers, contractors, and other service providers operating in Oʻahu, Hawaiʻi.

Unless we expressly state otherwise in writing:

We do not personally perform junk removal, hauling, demolition, moving, cleaning, recycling, disposal, or related services.
We are not a junk-removal contractor or waste-disposal company.
We are not the employer, partner, joint venturer, representative, or agent of any service provider listed on or contacted through the Site.
We do not control how an independent service provider performs its work.
We are not a party to any agreement entered into between a consumer and a service provider.

Any service agreement is made directly between the consumer and the independent service provider.

When you submit a request for junk removal or another service through the Site, you understand and agree that we may:

Collect the information you submit;
Use that information to evaluate and process your service request;
Share or sell your request and contact information to one or more independent service providers that may be able to assist you;
Contact you to clarify your request or help connect you with an available provider; and
Receive compensation from service providers for referrals, leads, advertising, listings, calls, appointments, or completed jobs.

Information shared with a service provider may include your name, telephone number, email address, service address or general location, requested service, preferred timing, photographs, descriptions of the items to be removed, and other information you voluntarily provide.

Submitting a request does not guarantee that a provider will contact you, accept the job, offer a particular price, or be available at your preferred time.

Our collection, use, and disclosure of personal information are also governed by our Privacy Policy.

3. Calls, Text Messages, and Emails

By submitting your contact information through a service-request form, you authorize Oahu Junk Haulers and the service providers identified or described at the point where you submit the form to contact you regarding the service you requested.

Contacts may be made by telephone call, text message, or email using the contact information you provide. Communications may include requests for additional information, appointment scheduling, estimates, service updates, and follow-up communications concerning your request.

Your consent applies only as disclosed on the applicable form and does not authorize unrelated marketing communications.

Message and data rates may apply to text messages. Message frequency varies. You may reply STOP to an applicable text message to request that text messages from that sender stop. You may reply HELP for assistance.

Consent to receive marketing calls or text messages is not a condition of purchasing services from any particular provider. However, a provider must be able to contact you to respond to a service request submitted through the Site.

You are responsible for providing a telephone number and email address that belong to you or that you are authorized to use.

4. Independent Service Providers

Service providers listed on, advertised through, or connected through the Site are independent businesses.

Each provider is solely responsible for:

Its qualifications, experience, employees, subcontractors, vehicles, equipment, and business practices;
Maintaining any licenses, registrations, permits, certifications, and insurance required for its work;
Inspecting the property and determining the scope of work;
Providing estimates, contracts, invoices, warranties, and receipts;
Performing services safely and professionally;
Complying with environmental, transportation, disposal, recycling, labor, tax, and consumer-protection laws;
Properly handling, transporting, recycling, donating, or disposing of collected materials; and
Resolving complaints, damage claims, billing disputes, or warranty issues arising from its services.

A provider’s appearance on the Site does not constitute a guarantee, certification, endorsement, or warranty by Oahu Junk Haulers.

5. Consumer Responsibility for Selecting a Provider

You are responsible for evaluating and selecting any service provider you hire.

Before hiring a provider, you should consider independently verifying the provider’s:

Business identity and contact information;
Licensing or registration status, when applicable;
Insurance coverage;
Experience and qualifications;
Customer reviews and references;
Written estimate and scope of work;
Disposal and recycling practices; and
Ability to legally complete the requested work.

Some junk-removal jobs may involve demolition, construction, hazardous materials, electrical work, plumbing work, structural work, or other activities that require specialized licenses or permits. You should verify that the provider is legally qualified to perform every part of the requested work.

We do not guarantee that information supplied by a provider or displayed on the Site is complete, current, or accurate.

6. Estimates, Pricing, and Payment

Any price, price range, cost calculator, estimate, or pricing information displayed on the Site is provided for general informational purposes only.

Actual prices may vary based on factors including:

The volume, weight, type, and condition of the items;
Accessibility and distance from the loading area;
Labor requirements;
Stairs, elevators, parking, or difficult access;
Disposal, landfill, recycling, or donation fees;
Hazardous or restricted materials;
Required equipment;
Travel distance;
Scheduling requirements; and
Additional services requested.

Only the provider you hire can give you a binding price or final invoice.

Unless we expressly state otherwise, payments for junk-removal services are made directly to the independent provider. We are not responsible for deposits, payment processing, refunds, cancellations, billing errors, financing, chargebacks, or disputes between you and a provider.

7. No Guarantee of Availability or Results

We do not guarantee:

That a service provider will be available;
That you will receive a response, estimate, or appointment;
That a provider will accept your project;
That services will be completed by a particular deadline;
That a quote will be the lowest available price;
That a provider will meet your expectations;
That items will be recycled, donated, or disposed of in a particular manner; or
Any particular result from using the Site or hiring a provider.

8. User Responsibilities

When using the Site, you agree to:

Provide truthful, current, and accurate information;
Describe the requested work as completely as reasonably possible;
Disclose known safety risks, hazardous materials, restricted items, access issues, or unusual conditions;
Submit requests only for properties or services you are authorized to manage;
Treat service providers and Site representatives respectfully;
Comply with applicable laws; and
Use the Site only for legitimate service-related purposes.

You may not:

Submit false, fraudulent, misleading, or duplicate service requests;
Impersonate another person or business;
Submit another person’s contact information without authorization;
Use the Site to harass, threaten, deceive, or solicit users or providers;
Attempt to gain unauthorized access to the Site or its systems;
Introduce malware, automated scraping tools, or harmful code;
Copy, republish, or commercially exploit Site content without permission; or
Use information obtained through the Site for unlawful or unrelated marketing.

9. Hazardous, Illegal, and Restricted Materials

The Site does not guarantee that a provider will remove every type of material.

Providers may refuse to collect hazardous, illegal, regulated, contaminated, or restricted materials, including certain chemicals, fuels, paints, oils, batteries, medical waste, asbestos-containing materials, explosives, firearms, ammunition, biological waste, pesticides, compressed gas cylinders, or other dangerous items.

You are responsible for accurately disclosing any potentially hazardous or regulated materials before a provider arrives. You must not conceal dangerous materials inside boxes, bags, furniture, appliances, or other items.

10. Property Access and Damage

You are responsible for providing lawful and reasonably safe access to the service location.

Any instructions concerning gates, parking, elevators, building access, pets, utility shutoffs, property boundaries, or restricted areas should be communicated directly to the provider.

Claims involving property damage, personal injury, missing property, unauthorized removal, or incomplete work must be addressed directly with the provider that performed the services. Oahu Junk Haulers is not responsible for the acts or omissions of independent providers.

11. Provider and Advertising Partner Terms

If you are a service provider, advertiser, contractor, hauler, or business receiving leads through the Site, you agree to:

Maintain all licenses, registrations, permits, insurance, and authorizations required for your operations;
Provide truthful information about your company, qualifications, availability, and services;
Contact consumers only regarding the service request for which their information was provided;
Comply with all applicable calling, texting, email, privacy, advertising, and consumer-protection laws;
Honor consumer opt-out and do-not-contact requests promptly;
Safeguard consumer information using reasonable security measures;
Not sell, transfer, or disclose a lead to another party unless expressly authorized in writing;
Not make false statements about your relationship with Oahu Junk Haulers;
Not represent that you are employed by, owned by, certified by, or endorsed by Oahu Junk Haulers;
Provide consumers with clear pricing and service terms;
Perform accepted work professionally and lawfully; and
Dispose of collected materials only through lawful facilities and methods.

Receipt of a lead does not guarantee that the lead will answer, hire you, qualify for service, or result in revenue. Unless a separate written agreement states otherwise, leads may be nonexclusive and may be provided to more than one service provider.

Lead prices, credits, refunds, territories, delivery methods, and other commercial terms are governed by the provider’s separate advertising or lead-purchase agreement with us.

12. Directory Listings and Provider Information

We may create, edit, organize, display, suspend, or remove provider listings at our discretion.

Some listings may be paid advertisements or sponsored placements. Placement, visibility, or ranking may be influenced by advertising arrangements, availability, location, relevance, or other business considerations.

We do not guarantee that listing information is accurate or current. Providers are responsible for notifying us of inaccurate information associated with their listings.

We reserve the right, but do not assume an obligation, to review provider information, investigate complaints, verify credentials, or remove providers from the Site.

13. Reviews and User Content

The Site may allow users to submit reviews, photographs, comments, descriptions, or other content.

By submitting content, you represent that:

You have the right to submit it;
It is truthful and based on your genuine experience;
It does not violate another person’s privacy or intellectual-property rights;
It is not defamatory, threatening, fraudulent, obscene, or unlawful; and
You have obtained any necessary permission to submit photographs or information involving other people or private property.

You grant us a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, edit, publish, display, and distribute content you submit for Site operations, marketing, and promotional purposes.

We may remove or decline to publish content at our discretion.

14. Intellectual Property

The Site and its original content, branding, logos, graphics, page designs, text, software, and functionality are owned by or licensed to Oahu Junk Haulers and are protected by applicable intellectual-property laws.

You may use the Site only for personal, noncommercial purposes related to finding or providing services. No ownership rights are transferred to you.

“Oahu Junk Haulers,” OahuJunkHaulers.com, associated logos, and related branding may not be copied or used without prior written permission.

15. Third-Party Websites and Services

The Site may contain links to third-party websites, maps, payment platforms, review sites, social networks, advertisers, or other services.

We do not control and are not responsible for third-party content, availability, privacy practices, security, products, or services. Accessing a third-party website is at your own risk and is governed by that third party’s terms and policies.

16. Disclaimer of Warranties

To the fullest extent permitted by law, the Site is provided on an “as is” and “as available” basis.

We disclaim all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, security, and satisfactory quality.

We do not warrant that:

The Site will always be available, secure, or error-free;
Site content will be accurate, complete, or current;
Defects will be corrected;
Any provider is qualified, insured, licensed, reliable, or suitable;
Any service will be performed safely, legally, or satisfactorily; or
Your use of the Site will produce a particular result.

Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

17. Limitation of Liability

To the fullest extent permitted by law, Oahu Junk Haulers and its owners, officers, employees, agents, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

Your use of or inability to use the Site;
Information submitted through the Site;
Communications from a service provider;
Your selection, hiring, or use of a provider;
The price, quality, timeliness, legality, safety, or outcome of services;
Property damage, bodily injury, disposal practices, missed appointments, or incomplete work;
Unauthorized access to information;
Third-party websites or services; or
Any dispute between a consumer and a provider.

To the fullest extent permitted by law, our total liability for any claim related to the Site will not exceed the greater of:

The amount you paid directly to us for use of the Site during the six months preceding the event giving rise to the claim; or
One hundred U.S. dollars.

This limitation does not apply where liability cannot legally be limited or excluded.

18. Indemnification

You agree to defend, indemnify, and hold harmless Oahu Junk Haulers and its owners, officers, employees, agents, affiliates, and licensors from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising out of or related to:

Your violation of these Terms;
Your misuse of the Site;
Information or content you submit;
Your violation of another person’s rights;
Your violation of applicable law; or
If you are a provider, your communications, estimates, contracts, employees, subcontractors, services, disposal practices, or business operations.

19. Suspension and Termination

We may restrict, suspend, or terminate access to the Site at any time if we reasonably believe that a user or provider:

Violated these Terms;
Submitted fraudulent or abusive requests;
Misused consumer information;
Created a legal, safety, privacy, or security risk;
Failed to pay agreed advertising or lead fees; or
Engaged in conduct that could harm consumers, providers, the Site, or our reputation.

Sections that by their nature should survive termination will remain in effect, including intellectual-property, disclaimer, liability, indemnification, and dispute provisions.

20. Governing Law and Disputes

These Terms are governed by the laws of the State of Hawaiʻi, without regard to conflict-of-law principles.

Before filing a legal claim, you agree to send us written notice describing the dispute and allow at least 30 days for the parties to attempt an informal resolution.

Unless applicable law requires otherwise, any legal action arising from these Terms or the Site must be filed in a state or federal court with jurisdiction over Honolulu County, Hawaiʻi. You consent to the personal jurisdiction and venue of those courts.

Nothing in this section prevents either party from seeking injunctive relief or filing a qualifying claim in small claims court.

21. Changes to These Terms

We may revise these Terms periodically. Updated Terms will be posted on this page with a revised effective date.

Changes become effective when posted unless a later date is stated. Your continued use of the Site after updated Terms become effective constitutes acceptance of the revised Terms.

22. Severability

If any part of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

23. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

24. Entire Agreement

These Terms, together with our Privacy Policy and any additional written agreement applicable to a particular service or provider relationship, constitute the entire agreement concerning use of the Site.

If a separate signed agreement between us and a service provider conflicts with these Terms, the separate signed agreement controls with respect to that provider relationship.
